Part K:
Revision and Withdrawal of Awards

Part K allows ill-health awards to be reduced where permanent disablement is due to the person’s own default (Rule K3) and explains how ill-health awards (and deferred pensions paid early on health grounds) should be reviewed (Rule K1) and withdrawn on recovery (Rule K1A). It also deals with abatement of pension on re-employment as a regular firefighter (Rule K4) and the possible forfeiture of an award on conviction of an offence (Rule K5).

Before 1 April 2006, injury pensions were payable under the FPS. From that date the provisions were transferred to the Firefighters' Compensation Scheme. Rule K1 used to cover the review and withdrawal of injury awards. An explanation of Rule K1 as it applied up to 31 March 2006 appears at the end of the explanation of current Rule K1 as "archived" material in case it is needed for old cases. Also it was on 1 April 2006 that two tier ill-health awards were introduced. Rule 3 of the Transitional Provisions of the Firefighters' Pension Scheme (Amendment) (England) Order 2006 allows ill-health awards and deferred awards decided before 1 April 2006 to be reviewed under Rule K1 as it stood before amendment from that date. Consequently the "old terms" have here been written into the explanation of Rule K1.
